1. Scope

This Privacy Policy explains how Midwest Wellness LLC (“we,” “us,” “our”) collects, uses, discloses, and safeguards information when you interact with our website, applications, communications, products, and services (collectively, the “Services”). By using the Services, you consent to this Policy. This Policy does not create any contractual rights and may be updated at any time.

2. Not a HIPAA Covered Entity

Unless we expressly notify you otherwise in a written Business Associate Agreement or Notice of Privacy Practices, Midwest Wellness is NOT acting as a HIPAA-covered entity, and information you provide is not treated as Protected Health Information (PHI) under HIPAA. Wellness and lifestyle data you share is governed by this Policy, not HIPAA.

3. Information We Collect

We may collect: (a) identifiers (name, email, phone, address, date of birth, government ID for age verification); (b) account credentials; (c) payment information (processed by third-party processors); (d) health, wellness, lifestyle, fitness, and goal information you voluntarily provide; (e) communications (calls, texts, emails, chat); (f) device and usage data (IP address, device identifiers, browser type, pages viewed, referrers, timestamps, cookies, and similar technologies); (g) location data; and (h) any other information you choose to provide.

4. How We Use Information

We use information to: provide and operate the Services; verify identity and eligibility; process orders, schedule deliveries, and bill you; communicate with you (including marketing where permitted); personalize your experience; conduct analytics and research; detect and prevent fraud, abuse, and security incidents; comply with law; and enforce our Terms.

5. Legal Bases (where applicable)

Where the GDPR, UK GDPR, or similar laws apply, we process personal data under one or more bases: consent, contract performance, legitimate interests (operating and improving the Services), and legal obligations.

We do not “sell” personal information for monetary consideration; certain disclosures for cross-context behavioral advertising may qualify as a “sale” or “share” under California law and you may opt out as described below.

We use cookies, pixels, SDKs, local storage, and similar technologies to operate the Services, remember preferences, perform analytics, and deliver advertising. You can control cookies via your browser settings. Some features may not function if cookies are disabled.

8. Your Rights

Depending on your jurisdiction, you may have rights to: access, correct, delete, or port your personal information; restrict or object to processing; withdraw consent; and lodge a complaint with a supervisory authority. California residents have rights under the CCPA/CPRA, including the right to know, delete, correct, and opt out of sale/sharing and certain profiling. We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by data type and purpose.

We employ administrative, technical, and physical safeguards designed to protect personal information. No system is perfectly secure, however, and we do not warrant absolute security. You are responsible for safeguarding your account credentials.

11. International Transfers

Your information may be processed in the United States and other jurisdictions whose data protection laws may differ from your own. Where required, we rely on appropriate transfer mechanisms (e.g., Standard Contractual Clauses).

12. Children

The Services are not directed to individuals under 21 and we do not knowingly collect personal information from minors. If you believe a minor has provided us information, contact us and we will delete it.

13. Third-Party Links and Services

We are not responsible for the privacy practices of third-party sites, products, or services linked from or integrated with our Services. Review their policies before use.

14. Marketing Choices

You may opt out of marketing emails via the unsubscribe link and out of text messages by replying STOP. Transactional messages necessary to operate the Services may continue.

15. Do Not Track / Global Privacy Control

We honor recognized Global Privacy Control (GPC) signals as opt-out requests for sale/sharing where required by law. We do not separately respond to legacy “Do Not Track” signals.

16. Changes to this Policy

We may update this Policy at any time. Material changes will be indicated by an updated “Last updated” date and, where required, additional notice. Continued use after changes constitutes acceptance.
